Marine Order Part 3 - Seagoing qualifications

Description of Issue

Marine Orders Part 3 is made pursuant to the Navigation Act 1912 and specifies the standards of competence and other conditions to be met by a person in order to be a qualified master, officer or seaman of an Australian ship. It gives effect to the International Maritime Organization (IMO) International Convention for Standards of Training, Certification and Watchkeeping for Seafarers 1978 as amended in 1995 and 1997 (STCW Convention).

Marine Orders Part 3, Issue 6, repealed Issue 5 and maintained the alignment of Australian issued seafarers' qualifications with the STCW Convention and simplified the structure of deck officer certificates of competency.

Marine Order Part 12 - Construction - subdivision & stability, machinery and electirical installations

Description of Issue

Marine Orders Part 12, is made pursuant to the Navigation Act 1912 and specifies the requirements for the constructions, hull, equipment and machinery on ships giving effect to Chapter II-1 of the International Maritime Organization (IMO) International Convention for the Safety of Life at Sea (SOLAS), 1974, as amended and IMO guidelines for the design and construction of offshore supply vessels.

Marine Orders Part 12 was amended to give effect to IMO amendments to Chapter II-1 of SOLAS that entered into force internationally on 1 July 2004. SOLAS amendments were in relation to means of access to cargo and other spaces and the ship structure access manual.

Marine Order Part 15 -  Construction - fire protection, fire detection and fire extinction

Description of Issue

Marine Orders Part 15 is made pursuant to the Navigation Act 1912 and gives effect to Chapter II-2 of the International Maritime Organization (IMO) International Convention on Safety of Life at Sea (SOLAS) 1974, as amended, and makes provision for the prevention, detection and extinction of fire on SOLAS and non-SOLAS ships.

Marine Orders Part 15 was amended to give effect to IMO amendments to SOLAS Chapter II-2 that entered into force nationally on 1 July 2004. The amendments were in relation to the carriage of dangerous goods.

Marine Order Part 16 -  Load Lines

Description of Issue

Marine Orders Part 16 is made pursuant to the Navigation Act 1912 and gives effect to the International Convention on Load Lines 1966 as amended by the protocol of 1988. It covers detailed requirements for ships to have been surveyed, marked and issued with an International Load Line Certificate, including determining load lines, the form of load line marks and their positioning on a ship and for maintaining the external weathertight and watertight integrity of the ship.

Marine Orders Part 16 was revised to give effect to IMO amendments to the 1988 protocol to the International Convention on Load Lines 1966. The amendments, which amounted to a comprehensive revision of the technical regulations of the original Load Lines (LL) Convention, did not effect the 1966 LL Convention and only applied to those ships flying the flags of States (including Australia) party to the 1988 Protocol.

Marine Orders Part 25 - Equipment - Life-saving

Description of Issue

Marine Orders Part 25, is made pursuant to the Navigation Act 1912, and gives effect to Chapter III(Life-saving appliances and arrangements) of the International Maritime Organization (IMO) International Convention for the Safety of Life at Sea (SOLAS), 1974, as amended, the International Life Saving Appliances Code (LSA Code) prescribing the appliances to be carried in ships for the saving of life at sea.

Marine Orders Part 25 was reviewed to give effect to IMO amendments to SOLAS Chapter III that entered into force internationally on 1 July 2004. The SOLAS amendment was in relation to fitting of radar transponders in liferafts carried on ro-ro passenger ships.

Marine Orders Part 33 - Cargo and cargo handling - grain

Description of Issue

Marine Orders Part 33 is made pursuant to the Navigation Act 1912 and specifies matters relating to the stowage and carriage of grain in bulk on Australian ships and foreign ships in Australian territorial waters. it also gives effect to Part C of Chapter VI (Carriage of grain) of the International Martime Organization (IMO) International Convention for the Safety of Life at Sea (SOLAS) 1974, as amended.

Marine Orders Part 33 was being amended for changes in inspection procedures for bulk grain cargo.

Marine Order Part 55 - Publication of inspection data

Description of Issue

Marine Orders Part 55 is made pursuant to the Navigation Act 1912 and prescribes the nature of information that AMSA may publish about a ship and the manner in which it should be published. The information may be derived during an inspection or survey conducted by AMSA under the Act and includes information about the ship (name, number, size, kind, age etc), its country of registration, the Classification society, the nature of deficiencies found and action taken to correct them. Different publication methods are allowed, ranging from the release of individual inspection reports to the publication of annual statistical reports.

Marine Orders Part 55 was reviewed to provide for additional matters to be included in the prescribed information that can be published.

Marine Order Part 56 - REEFREP

Description of Issue

Marine Orders Part 56 is made pursuant to the Navigation Act 1912, and gives effect to the mandatory ship reporting system operating in the Great Barrier Reef and Torres Strait region as approved under Chapter V of the International Maritime Organization (IMO) International Convention for the Safety of Life at Sea (SOLAS) 1974, as amended.

Marine Orders Part 56 was amended to give effect to the upgrading of the mandatory ship reporting system "in the Torres Strait and Inner Route of the Great Barrier Reef", adopted by the IMO resolution MSC.161(78), which entered into force on 1 December 2004.

Marine Orders Part 91 - Marine Pollution Prevention - Oil

Description of Issue

Marine Orders Part 91 is made pursuant to the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 (Pollution Prevention Act) and the Navigation Act 1912 to give effect to various regulations of Annex 1 (Regulations for the Prevention of Pollution by Oil) of the International Maritime Organization (IMO) International Convention for the Prevention of Pollution from Ships 1973, as amended by the Protocol of 1978 (MARPOL 73/78). This Part also prescribes various matters, such as survey and certification requirements and appropriate forms to be used to report pollution incidents. Marine Orders Part 91, Issue 4 repeals Issue 3 and was revised to give effect to MARPOL amendments that entered into force internationally on 5 April 2005. These amendments are in relation to phasing out of single hull oil tankers.

Marine Orders Part 93 - Marine Pollution Prevention - Noxious Liquid Substances

Description of Issue

Marine Orders Part 93 is made pursuant to the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 (Pollution Prevention Act) and the Navigation Act 1912 to give effect to various regulations of Annex II (Regualtions for the Control of Pollution by NLS) of the International Maritime Organization (IMO) International Convention for the Prevention of Pollution from Ships 1973, as amended by the Protocol of 1978 (MARPOL 73/78).

Marine Orders Part 93, Issue 4 repealed Issue 3 and updated reference to the version of MARPOL 73/78.

Marine Order Part 3 - Seagoing qualifications

Description of Issue

Marine Orders Part 3 is made pursuant to the Navigation Act 1912 and specifies the standards of competence and other conditions to be met by a person in order to be a qualified master, officer or seaman of an Australian ship. It gives effect to the International Maritime Organization (IMO) International Convention for Standards of Training, Certification and Watchkeeping for Seafarers 1978 as amended in 1995 (STCW Convention).

Marine Orders Part 3, Issue 6 is to be revised to update initial training requirements for engineer officer qualification.

Marine Order Part 9 - Health - Medical fitness

Description of Issue

Marine Orders Part 9 is made pursuant to the Navigation Act 1912 and prescribes matters pertaining to medical fitness standards of seafarers and coastal pilots and gives effect to the International Labour Organization (ILO) Medical Examination (Seafarers) Convention, 1946. It also gives effect to certain provisions of the International Maritime Organization (IMO) International Convention for Standards of Training, Certification and Watchkeeping for Seafarers 1978 as amended in 1995 and 1997 (STCW Convention).

Marine Orders Part 9 is being reviewed as part of AMSA's five yearly cycle to regularly review all Marine Orders and to update its requirements in line with STCW Convention and to remove unnecessary procedural matters and outdated references.

Date of Effect The amendment is planned to be introduced in January 2006

Marine Order Part 12 - Construction - subdivision & stability, machinery and electirical installations

Description of Issue

Marine Orders Part 12, is made pursuant to the Navigation Act 1912 and gives effect to Chapter II-1 (Construction - structure, stability, installations) of the International Convention for the Safety of Life at Sea (SOLAS), 1974, as amended.

Marine Orders Part 12 is to be reviewed as part of five yearly review cycle and to update reference to the version of SOLAS, consequent to adoption of amendments to Chapter II-1 of SOLAS by IMO resolutions MSC.151(78) and MSC.170(79).

Marine Order Part 21 -Safety of navigation and emergency procedures

Description of Issue

Marine Orders Part 21, is made pursuant to the Navigation Act 1912 and gives effect to Chapter V (safety of navigation) of the International Convention for the Safety of Life at Sea (SOLAS), 1974, as amended.

Marine Orders Part 21 is to be revised to update reference to the version of SOLAS, following adoption of amendments to chapter V of SOLAS by IMO resolutions MSC.142(77), MSC.153(78), and 170(79).

Date of Effect 1 July 2006

Marine Order Part 25 - Equipment - Life-saving

Description of Issue

Marine Orders Part 25, is made pursuant to the Navigation Act 1912, and gives effect to relevant parts of the International Maritime Organization (IMO) International Convention for the Safety of Life at Sea (SOLAS) 1974, as amended, in relation to Chapter III of SOLAS and the International Life Saving Appliances Code (LSA Code) prescribing the appliances to be carried in ships for the saving of life at sea.

Marine Orders Part 25 is being reviewed to ensure requirements harmonise with SOLAS Chapter III, where appropriate.

Date of Effect The amendment is planned for introduction by December 2005.

Marine Order Part 30 - Prevention of Collisions

Description of Issue

Marine Orders Part 30, is made pursuant to the Navigation Act 1912 and specifies measures to be observed for the prevention of collisions and specifies lights and signals to be provided and used on a ship. It implements the International Maritime Organization (IMO) International Convention on the International Regulations for preventing Collisions at Sea (COLREG) 1972.

Marine Orders Part 30, Issue 6, is being amended to incorporate IMO corrections to the consolidated edition of COLREG published in the 2003 edition.

Date of Effect The amendment is planned for introduction in July 2005

Marine Order Part 31 - Ship surveys and certification

Description of Issue

Marine Orders Part 31, is made pursuant to the Navigation Act 1912 and makes provision for the survey, inspection and certification of ships in relation to Chapter I (general provisions) of the International Convention for the Safety of Life at Sea (SOLAS), 1974, as amended.

Marine Orders part 31 is to be revised to update the forms of certificates contained in the appendix of the MO, following the adoption of amendments to the forms by IMO resolutions MSC.152(78), MSC.154(78) and MSC.170(79).

Date of Effect 1 July 2006

Marine Order Part 32 - Cargo handling equipment

Description of Issue

Marine Orders Part 32 is made pursuant to the Navigation Act 1912, and specifies matters in relation to the loading and unloading of cargo and the safe transfer of persons, from ships, off-shore industry vessels and off-shore industry mobile units and gives effect to the International Labour Organization (ILO) Conventions, No 152 Occupational Safety and Health (Dock Work) 1979 and No 27, Marking of Weight (Packages Transported by Vessels) 1929. It also gives effect to the ILO Code of Practice, Safety and Health in Dock Work, and ILO Recommendation 160, Occupational Safety and Health (Dock Work) 1979.

Marine Orders Part 32 is being reviewed as part of AMSA's five yearly cycle to regularly review all Marine Orders to update its requirements in line with modern safety practice and to remove unnecessary procedural matters and outdated references.

Date of Effect The amendment is planned for introduction by late 2006

Marine Order Part 35 - Additional safety measures for bulk carriers

Description of Issue

Marine Orders Part 35 is made pursuant to the Navigation Act 1912 and gives effect to Chapter XII (additional safety measures for bulk carriers) of the International Convention for the Safety of Life at Sea (SOLAS), 1974, as amended.

Marine Orders Part 35 is to be revised to update reference to the version of SOLAS, following adoption of amendments to Chapter XII by IMO resolution MSC.170(79).

Date of Effect 1 July 2006

Marine Order Part 41 - Carriage of dangerous goods

Description of Issue

Marine Orders Part 41 is made pursuant to the Navigation Act 1912 and gives effect to Parts A and D of Chapter VII of the International Maritime Organization (IMO) International Convention for the Safety of Life at Sea (SOLAS) 1974, as amended, in relation to the carriage of dangerous cargoes in packaged form and gives effect to the International Maritime Dangerous Goods Code (IMDG Code).

Marine Orders Part 41 is being amended to give effect to changes to the IMDG Code adopted by the IMO resolution MSC.157(78).

Date of Effect The amendment is planned for introductionby 1 January 2006

Marine Order Part 43 - Cargo and cargo handling - livestock

Description of Issue

Marine Orders Part 43 is made pursuant to the Navigation Act 1912 and prescribes conditions for the stowage and carriage of livestock by ship and also provides for the survey, inspection, and certification of ships in relation to the carriage of livestock.

Marine Orders Part 43 is to be revised to remove animal welfare standards. Animal welfare standards are now contained in the Australian Standards for the Export of Livestock (ASEL) issued by the Department of Agriculture, Fisheries and Forestry (DAFF) and administered by the Australian Quarantine and Inspection Service (AQIS).

Marine Order Part 51 - Fishing Vessels

Description of Issue

Marine Orders Part 51 is made pursuant to the Navigation Act 1912 and gives effect to requirements relating to stability, subdivision, and crew qualifications, for fishing vessels.

Marine Orders Part 51 is being reviewed with a view to including provisions permitting the survey of fishing vessels, on a voluntary basis, to the standards provided in the Torremolinos International Convention for the Safety of Fishing Vessels (SFV). Consideration will also be given to modifications required to the appendices relating to certification of deck and engineer officers to permit Australian ratification of the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers on Fishing Vessels (STCW-F).

Date of Effect The amendment is planned for introduction by late 2006

Marine Order Part 54 - Coastal Pilotage

Description of Issue

Marine Orders Part 54 is made pursuant to the Navigation Act 1912 and provides for the licensing of coastal pilots and makes provision for matters dealing with the functions, conduct and liability of pilots.

Marine Orders Part 54 is being amended in relation to pilot licensing and the application of the Great Barrier Reef Pilotage Safety Management Code to give effect to the IMO's approval in July 2005 for the extension to Torres Strait of the Particular Sensitive Sea Area applying to the Great Barrier Reef and the associated protective measures in relation to pilotage.

Date of Effect The amendment is planned for introduction by early 2006

Marine Order Part 94 - Marine Pollution Prevention - Packaged Harmful Substances

Description of Issue

Marine Orders Part 94 is made pursuant to the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 (Pollution Prevention Act) and the Navigation Act 1912 to give effect to Annex III of the International Maritime Organization (IMO) International Convention for the Prevention of Pollution from Ships 1973, as amended by the Protocol of 1978 (MARPOL 73/78).

Marine Orders Part 94, Issue 3 is to be revised for minor amendments to reflect consistency with Annex III of MARPOL 73/78.

Date of Effect The amendment is planned for introduction in August 2005

Marine Order Part 95 - Marine Pollution Prevention - Garbage

Description of Issue

Marine Orders Part 95 is made pursuant to the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 (Pollution Prevention Act) and the Navigation Act 1912 to give effect to Annex V of the International Maritime Organization (IMO) International Convention for the Prevention of Pollution from Ships 1973, as amended by the Protocol of 1978 (MARPOL 73/78). It pertains to a ship to which MARPOL 73/78 applies and prescribes conditions and procedures for disposal of garbage from a ship.

Marine Orders Part 95, Issue 2 is to be revised for minor amendments to update definitions.

Date of Effect The amendment is planned for introduction in August 2005
