Exemption application for temporary operations


Overview

You can use this form to make an application for temporary operations under Marine Safety (Temporary Operations) Exemption (also known as Exemption 07 or EX07) for operation:

  • without certificates
  • between initial survey and the issuing of certificates
  • after a certificate of survey and/or load line has expired
  • outside the scope of a vessel’s certificates.

A temporary operations approval can only be issued for up to a maximum of 90 days.

Vessel owners and operators are expected to hold the appropriate National Law certification rather than seeking repeated temporary exemptions approvals. The National Regulators policy is that subsequent temporary operations approvals (where the application is for the same reason as the initial application) will not be granted unless extraordinary circumstances exist.

If you need more time to complete a periodic survey, you should apply for approval under the Marine Safety (Periodic survey, equipment certification and compass adjustment) Exemption.

Note that if your certificate is due to expire and you have made your renewal application, you may be eligible for temporary operations for up to 120 days after the certificate expiry date without needing to apply for an approval. To be eligible to operate without an approval issued by the National Regulator, after the expiry of a certificate of survey, you must have completed all of the renewal surveys and your surveyor must give you a document that confirms the surveys have been conducted and the vessel complies with the applicable standards.

Trust and organisation arrangements

If you are applying as an organisation, please provide documentation confirming your ABN and/or ACN and business name—for example ASIC extract.

If you are making an application in the name of a trust, please supply a copy of the trust deed in the supporting documents section of the application. We require the deed to confirm the full and correct name of the legal entity that is making the application. If a copy of the trust deed is not submitted at the time of making the application, it may result in delays processing your application.
