Miscellaneous form (for matters not covered by other forms)


Overview

You can use this form to apply for or notify us of matters not covered by other forms. This includes determinations under Exemption 02 or Exemption 40.

To process your application, the specified information and documentation must be included with the AMSA Form 758 for each matter below.

Exemption 15—Marine Safety (Scientific research and educational activities)

To apply to operate in ‘other waters’ for the purposes of exemption 15, please provide the following information:

  • vessel name and unique identifier
  • details of the proposed operation and geographical area(s)
  • details of how you will mitigate the risks of operating in the proposed area

AMSA policy is that an approval would not be issued if the proposed ‘other waters’ have higher environmental risks than those permitted by exemption 15.

Exemption 18—Marine Safety (Sail)

To use an equivalent certificate, please provide the following information:

  • copy(ies) of the completed certificate (if applicable)
  • details of the proposed training course
Exemption 25 - Marine Safety (Old certificates of competency—local restrictions)

Exemption 25 is for people who have an old certificate of competency and are not able to comply with a condition on that certificate. Please provide the following information:

  • details of the condition(s) on your certificate of competency that you are seeking to be exempt from
  • copy(ies) of your current certificate(s) of competency
Exemption 31—Marine Safety (Expired pre-USL Code certificates)

Exemption 31 allows you to work on a domestic commercial vessel without a certificate of competency, if you previously held an expired pre-USL certificate of competency. Please provide the following information:

  • copy(ies) of your expired pre-USL code certificate(s) of competency
  • vessel name and unique identifier
  • detailed description of the intended operation(s) and geographical area(s)
Exemption 36—Marine Safety (Steam-powered vessels)

Exemption 36 allows you to work on a steam powered domestic commercial vessel, of less than 750kW propulsion power, with a Marine Engine Driver Grade 2 Near Coastal or Marine Engine Driver Grade 3 Near Coastal certificate of competency. Please provide the following information (where applicable):

  • confirmation that you are at least 16 years of age
  • a statement of attainment from a registered training organisation, for the following units of the MAR Maritime Training Package:
    • MARF027 Apply basic survival skills in the event of vessel abandonment or equivalent
    • MARF028 Follow procedures to minimise and fight fires on board a vessel or equivalent
    • MARF029 Meet work health and safety requirements or equivalent
  • Copy of Basic Boiler Licence or a licence to operate a standard boiler (VET Code MSMBLIC001 or equivalent) issued by a State or Territory authority
  • Evidence that you meet the medical and eyesight requirements mentioned in Chapter 4 of NSCV Part D for a Marine Engine Driver Grade 3 NC certificate of competency
  • Evidence of at least 100 hours of sea service on vessels with steam as the main propulsion power undertaking duties as a general purpose hand or as an assistant to an engineer, an engine driver, a chief engineer or a second engineer
  • completed task book
  • first aid certificate
  • a statement of attainment from a registered training organisation for completion of MARF030 Survive at sea using survival craft (a unit of the MAR Maritime Training Package) or equivalent
  • any long term or permanent medical condition that is likely to affect your ability to perform the duties to which the exemption applies
Applying to make a change to an existing non-survey vessel or its operation under Division 5 of Exemption 02

Exemption 2 (division 5) allows you to change an existing non-survey vessel or its operations (under division 5 of exemption 02). Please include the following information:

  • the vessel name and unique identifier
  • details of any alterations that you are proposing to make the vessel
  • details of any changes you are proposing to make to the way the vessel is operated or where it is operated
  • how the proposed alteration of operational changes would not jeopardise safety of the vessel or persons onboard – for example survey reports, risk assessment etc.
  • details of how you will mitigate the risks of making the proposed changes

Approvals will not generally be granted, if the ‘type of change’ is one of those mentioned in Schedule 1 of Marine order 503.
