At the time of inspection the crew were unable to demonstrate the operation of the emergency fire pump within 15 minutes. Crew then primed the emergency fire pump by opening the Engine Room Isolation valve and running the Fire/General Service Pump during testing to demonstrate function against express instructions of attending PSCO in an apparent attempt to fool the PSCO.

The Safety Management System, as implemented on board, fails to ensure effective maintenance of ship and equipment, as evidenced by emergency generator defective, port and starboard steering gear hydraulic pump units showing signs of excessive oil leakage, cargo hold fire detection system in CO2 room showing faults with the sample line air flow and emergency power supply, speed log defective since 15/10/2019 (no evidence of reporting to R/O, Flag and Port State), emergency dewatering remote valve for forward space (pump room) valve no. 44 defective, remote operated (from fire control station) louvre type fire damper for port and starboard engine room ventilation fan defective (mushroom flap operational – engine room unattended as per minimum safe manning document), rescue boat fuel oil tank not topped up and no information from type approved certificate, ship specific SOLAS training manual or manufacturer instructions to specify quantity of fuel required for operation at 6 knots with 6 persons for a duration of 4 hours, Australian Seafarer Handbook AHP20 (4th edition) not current edition, port and starboard bridge wing man overboard self-activated light and smoke signal – activation line not installed as per manufacturer’s instruction, navigation light control panel – buzzer, main supply and supply failure LEDs not operational when tested, engine room fire main isolation valve in front of accommodation - valve spindle distorted and various portable cargo lights and ventilation fans in Bosun Store electrical power cable in unsafe condition.

The Safety Management System, as implemented on board, fails to adequately satisfy the requirements of the ISM Code related to shipboard operations, emergency preparedness and maintenance of ship and equipment, as evidenced by machinery space fire damper (purifier room) not operational, fire detection system and engine room upper deck platform isolated, dewatering system not operational, public address system not operational, port bridge wing MOB and boat deck lifebuoys bracket heavily corroded, monitoring, course alteration and position fixing not in accordance with passage plan. Key personnel unable to demonstrate full use of ECDIS, engineers not in charge of engineering watch in port as per shipboard working arrangement and work and rest hour records – engine room ratings maintaining independent watches, port lifeboat embarkation emergency light not working, port lifeboat embarkation emergency light not working, main deck several cargo hold booby hatches found with 50 percent of dog handles seized, non-return valves for all hatch coaming drain channel defective/missing, main deck, port and starboard side approximately 50 percent of all railings damaged, numerous ballast tank manholes on main deck not secured (not bolted down), general alarm call buttons on boat deck not operational, main engine fuel oil system, fuel injector high pressure pipes not insulated or sheathed, EEBD on generator platform low pressure, emergency switchboard earth monitoring system not operational, engine room sky light on main deck secured in open position at all times, key personnel unable to demonstrate the operation and function of dewatering system, no instructions available for normal and emergency operations, ECR – 3 chairs and upholstery defective, three emergency stop switches located on main deck not marked or indicated and found in broken condition, hatch #3 (aft) hydraulic ram oil leaking and hatch cover number 2 unable to operate on main hydraulic system, emergency system found used.

Serious deficiencies relating to ISMObjective evidence of high risk work conducted in the maintenance of boiler feed pump without completing cold work permit, electrical permit forms and following lock out/tag out procedures as included in the safety management system, which resulted in injury of two seafarers. DPA root cause analysis failed to determine failure of crew not completing required processes for above tasks. Evidence of confined space entry work conducted without completion of confined space permits.

Serious deficiencies relating to ISMThe Safety Management System, as implemented on board, does not ensure the safety of the environment as evidenced as evidenced by the vessel having fuel oil on board with Sulphur content in excess of 0.5%. Vessel does not have alternative means of compliance on board. Vessel consumed 43.5 cu M of High Sulphur fuel en-route to Brisbane from Norfolk Island. 236.91 Cu M are remaining. The Safety Management System, as implemented on board, does not ensure that critical shipboard operations are carried out effectively as evidenced by Vessels crew have not followed the voyage plan, masters standing orders, company requirements and standards of STCW code with reference to using multiple means of position fixing. On 21.12.19 no evidence of any positions fixed other than by GPS, crew unfamiliar with the plotting of radar range and bearing on ECDIS, risk assessment for planned anchoring and mooring operation at Ball Bay failed to identify all risks and provide adequate controls of risk. Vessel grounded during proposed mooring and anchoring operation. Company have no procedures for Ship to Ship cargo transfers. Risk assessment used by crew does not identify or address all risks. The Safety Management System, as implemented on board, fails to ensure that the company fulfils its requirements as evidenced by company procedures do not ensure that damage to vessel is reported to port State as required by SOLAS Ch I Reg 11 (c). Vessel grounded on 21.12.19 with considerable damage. This was not reported to port State.
Other serious deficienciesVessel has fuel oil onboard with Sulphur content in excess of 0.5%. Vessel does not have alternative means of compliance onboard. Vessel has consumed 43.5 cu M of High Sulphur fuel en-route to Brisbane from Norfolk Island. 236.91 Cu M are remaining.Vessel has ran out of fresh fruit and vegetables.Vessels' hull has been damaged in numerous locations ( Ballast Tanks 1P,2P.3P,3S, 4P and pipe tunnel).
