Overview
You can use this form to:
- apply for a class C restricted operations permit under Marine Safety (Class C restricted operations) Exemption, also known as Exemption 40 or EX40, instead of a certificate of survey.
- revoke (cancel) an existing Exemption 40 approval
- request changes to an existing Exemption 40 approval, including to:
- alter or modify the vessel
- transfer to a new holder (for example, you have bought the vessel)
- update current holder details (for example, change of name due to marriage)
- remove or change a condition
- change service categories or capacity
- update engine details
- change the vessel name.
Eligibility criteria
Your vessel must:
- be less than 12 metres long
- be a Class 2 (non-passenger) or Class 3 (fishing) vessel
- only operate in the part of operational area C, D and E waters that is approved for the vessel’s length
- comply with the conditions specified in Schedule 1 of the exemption
- undergo an initial survey by an accredited marine surveyor.
How to complete this form
- Apply for a new approval
To obtain this approval your vessel must undergo an exemption 40 survey and meet the applicable standards - see Schedule 1 of Exemption 40.
You'll receive a survey code after you apply. Give it to your surveyor and ask them to submit their report as soon as possible. We can't assess your application until we receive the vessel survey report.
- Transfer to you as the new owner
As the new owner, you'll need to upload:
- a photo of the vessel
- proof of the current holder's (seller's) agreement to transfer, such as a bill of sale, contract of sale or a statutory declaration.
- Apply as an organisation, registered partnership or trust
If you're applying in the name of an organisation or registered partnership, you'll need to provide an ABN or ACN.
If you're applying as a trust, you must provide a copy of the relevant pages of the trust deed that identify all current trustees, their names and details. Information about the operation or administration of the trust is not required. Please don't submit an application without this documentation. We cannot process your application without it.
