Consultation now open on updates to Marine Order 53 (Vessels in polar waters)

We are reviewing Marine Order 53 (Vessels in polar waters) 2016 to reflect new international safety requirements that apply to certain non-SOLAS vessels operating in polar waters from 1 January 2026.

The changes directly affect operators of the following vessels when operating in polar waters:

  • Fishing vessels of 24 metres length overall and above
  • Pleasure yachts of 300 gross tonnage and above not engaged in trade
  • Cargo ships of 300 gross tonnage and above but below 500 gross tonnage.

These vessels are required to comply with new Polar Code provisions relating to safety of navigation and voyage planning.

Why this review is happening

The International Maritime Organization (IMO) has adopted amendments to SOLAS Chapter XIV, extending partial application of the Polar Code to specified non-SOLAS vessels. As a signatory to these international agreements, Australia must give effect to these changes in domestic law.

To meet these obligations, we will amend and reissue Marine Order 53.  

What the review will cover

This is the first full review of MO53 since its introduction in 2016. The review will ensure the marine order is:

  • accurate and aligned with amended SOLAS and Polar Code requirements
  • clear, consistent, and written in plain English
  • easier for industry to understand and comply with.

The review will include:

  • consideration of issues raised by subject matter experts and stakeholders
  • updates to improve clarity and contemporary drafting style
  • refreshed and standardised terms and definitions
  • consequential amendments to Marine Order 31.
