Calculator for limits of liability
The costs of responding to ship-sourced oil spills in Australian waters are met by those responsible for the spill through various Australian and international arrangements.
The calculator displays the limit of liability for oil pollution damage by oil-carrying ships under:
- International Convention on Civil Liability for Oil Pollution Damage 1992 (CLC92)
- International Convention on Civil Liability for Bunker Oil Pollution Damage 2001 (Bunkers Convention).
The Convention on Limitation of Liability for Maritime Claims 1976 as amended by the protocol of 1996 (LLMC96) defines the shipowner's limit of liability under the Bunkers Convention. The calculator uses the limits in force under Australian law from 8 June 2015.
For oil tankers, the calculator provides an estimate in Australian dollars of the maximum compensation potentially available through the International Oil Pollution Compensation (IOPC) Funds—the 1992 Fund and the Supplementary Fund.
