Exemption 16—Marine Safety (Traditional fishing)

This exemption is for people who want to work on a domestic commercial vessel that is a traditional inhabitant fishing boat without the required certificate of competency.

You do not need to apply to use this exemption. 

You will need to keep all the supporting documents on board and ready to be presented to authorities if required.

What this exemption will allow you to do

Exemption 16 will allow you to perform duties without a certificate of competency on a traditional inhabitant fishing boat which is fishing for the purpose of profit or barter. 

You cannot use the vessel for any other purpose if you are operating under this exemption.

To be eligible for Exemption 16 you must be a traditional inhabitant of the area in which the specified operation is to be held.

To obtain this exemption you will need to complete the specified training courses and hold the specified certificates.

Training courses

You are required to complete the following training courses:

  • SFIVOP204 — Operate and maintain outboard motors or equivalent unit; and
  • MARSS00008 — Shipboard Safety Skill Set or equivalent unit of the MAR maritime training package or other training that the National Regulator considers to be an equivalent program; and
  • Boatsafe recreational boat license course

Existing certificates

You must have:

  • A current Certificate I, issued under the Australian Qualifications Framework, restricted to the waters in which the specified is to be conducted, and which includes the training courses listed above, OR a Coxswain grade 2 near coastal certificate; and
  • Short Range Operator Certificate of Proficiency issued by the Australian Communications and Media Authority or its delegate or another course that the National Regulator considers to be equivalent; and
  • a current first aid certificate of at least HLTAID003 Provide first aid or another course that the National Regulator considers to be equivalent.
